Dear Homeowner:

This section contains information pertaining to our subdivision as well as subdivision restrictions and by-laws. This information is important because it governs us as a community and should be protected as you would your other personal and private papers and effects. If you should eventually decide to move from Sugarwood, please make these documents available to the people who purchase your home. This section addresses how the maintenance fee is determined, remedies and liens that can affect your property. We strongly suggest that all new homeowners read these documents carefully so as to be informed of the requirements of the subdivision restrictions and by-laws and what their personal responsibility is as a resident of Sugarwood Subdivision.

I. INTRODUCTION - LETTER FROM THE BOARD PRESIDENT

As a homeowner in Sugarwood Subdivision, you automatically become eligible to become a member of the Sugarwood Homeowner’s Association (SHA) . The SHA Board of Directors is an elected body by vote of the homeowners members, that works together to ensure compliance to the SHA restrictive covenants and by-laws.

As Sugarwood Subdivision homeowners, we have joint ownership of the Subdivision property. The SHA is responsible for improving and preserving the grounds and other common elements, as well as securing property, liability, and other insurance coverage for occurrences within the common grounds. The SHA is also responsible for selecting the services to the common areas, such as maintaining and managing the grounds. No owner may be exempt from liability for his or her contribution toward the expenses of the administration by waiver of the use of enjoyment of any of the common grounds. The invoiced annual SHA dues should be paid as indicated and on time.

The SHA elects a Board of Directors from our homeowner members and delegates to the Board the authority to administer our Homeowner’s Association business responsibilities. Your personal interest, involvement and membership in the SHA committees are essential to help “make it happen”. Our homes and common areas are only what the residents and the Association make of them.

One of the fundamental purposes of the SHA is to develop and enforce subdivision By-Laws, which in turn will enhance the ownership property values for all residents. Subdivision Restrictions supplement the subdivision By-Laws and are the documents that provide the legal basis for protecting each homeowner’s investment and for providing the framework within which we can all live in harmony in our neighborhood. It is hoped that you, the homeowner, will recognize and accept the attached Subdivision By-Laws and Restrictions. These documents should be viewed as the tools needed to keep our subdivision a pleasant living environment for all residents.

The Declaration of Subdivision Restrictions and By-Laws outline the rights, powers and responsibilities of the SHA members. These documents apply to all residents of Sugarwood Subdivision and are enclosed with this packet. No one is excluded.


Dear Homeowner:

On behalf of the Sugarwood Homeowner’s Association and myself I’d like to welcome you to your new home. Let me give you a brief introduction to your new neighborhood.

Sugarwood is one of the newest subdivisions in the city. It is comprised of approximately 230 homes and is located off of LA Highway 311, which gives us conveinent access to the many facilities located along Martin Luther King Blvd.

SHA also is responsible for the maintenance of the front entrance of the subdivision. That maintenance is one of the primary responsibilities of the Sugarwood Homeowners Association (SHA). Other expenses include maintenance, attorney fees, capitol improvements, a newsletter that is published quarterly, and miscellaneous expenses that complete the budget.

It is our responsibility, as elected representatives of the SHA, is to maintain our subdivision as economically and efficiently as possible. It is the responsibility of every homeowner in Sugarwood to support SHA and pay a membership in order help us accomplish this. If you have ever resided in a subdivision before, subdivision associations are not new to you. To many of you, however, this may be brand new and we hope that this information packet will explain things to you.

While we do have a great deal of responsibility for many things within our subdivision, the City does take care of waste removal, road repair and replacement and any legal or traffic infractions that may occur in our neighborhood.

It is our hope that you and your family will enjoy living in Sugarwood. We hope that this packet makes your introduction to your new neighborhood a little easier. Please do not hesitate to contact me or any Board member with any questions or comments you may have. Our phone numbers are located elsewhere in this packet. Future communication will be made via our web site, quarterly newsletter and via the annual report sent out each spring.

II. SHA - BOARD OF DIRECTORS

PRESIDENT: FERNIS LEBLANC
The President shall preside at all meetings of the Board of Directors; shall see that orders and resolutions of the Board are carried out, shall sign all leases, mortgages, deeds and other written instruments and shall co-sign all checks and promissory notes. The President is the individual responsible for the preparation of the Annual Report to Subdivision Homeowners and the scheduling of all board of directors meetings and agenda.

VICE-PRESIDENT: JODY NAQUIN
The Vice-President shall act in the place of, or instead of, the President in the event of absence, inability or refusal to act, and shall exercise and discharge such other duties as may be required of him by the Board of Directors.

SECRETARY: BECKY LANAUX
The Secretary shall record the votes and keep the minutes of all meetings and proceedings of the Board of Directors and of the members; serve notice of meetings of the Board of Directors and of the members; keep appropriate current records showing the members of the Homeowners Association together with their addresses, and shall perform other duties as required by the Board of Directors.

TREASURER: TOMMY LANAUX
The Treasurer shall receive and deposit in appropriate bank accounts all monies of the Homeowners Association and shall disburse such funds as directed by resolution of the Board of Directors provided however, that a resolution of the Board of Directors shall not be necessary for disbursements made in the ordinary course of business conducted within the limits of a budget adopted by the Board of Directors; shall aquire signatures from the President and the Vice President of the SHA Board for all checks and promissory notes of the Homeowners Association; keep proper books of accounts; cause an annual audit of the Homeowners Association books to be made by a Certified Public Accountant at the completion of each fiscal year; and shall prepare an annual budget and a statement of income and expenditures for presentation to the members at its regular annual meeting, and make available a copy of each to the members.

III. BY-LAWS and DEED RESTRICTIONS

Said restrictions in whole or in part may be modified at any time during their existence or any extension as provided herein below, by agreement in writing executed by owners representing at least seventy-five (75%) percent of the land area affected by said restrictions exclusive of streets and their rights-of way. Prior to effecting any amendments, notice shall be sent to all lot owners in the area covered by the restrictions herein, addressed to their last known address, fixing a time and place for a meeting to discuss such proposed changes. In no event shall said meeting be held less than fifteen (15) days from date of posting of said notice.

As your elected representatives, the Board of Directors intends to insure compliance by all subdivision homeowners to these Restrictive Covenants. We appreciate your continued cooperation and membership support in all Sugarwood Homeowner’s Association matters. The Restrictive Covenants can be viewed or downloaded here.
